Assistance required for implementation Support to:
1. Establish a mechanism of addressing an error where a person voluntarily discloses to a Kenya Customs administration the circumstances of a breach of customs law, regulations, or procedural requirements prior to the discovery of that breach by custom administration;
2. Formulate guidelines and policies which will help the officers distinguish between a mistake and fraudulent conduct before imposing penalties;
3. Develop procedure manuals for assessment of mitigations, settlement and collection of civil and administrative penalties; and
4. Align domestic law with the relevant provisions of the Trade Facilitation Agreement.

(i) Established a legal framework/mechanism to guide on the application of penalties.
(ii) Review national laws to align them with the provisions of the TFA.
